It's very fucked up but I'm not really surprised. I've mentioned this Shoot First law here before.

Fla. Teen's Shooting Creates 'Shoot First' Law Conundrum
The U.S. Justice Department is now investigating the shooting of an unarmed Florida teenager, and Florida's Castle doctrine law -- which is very similar to the so-called "shoot first" bill vetoed in Minnesota recently -- is making prosecuting the gunman difficult.

Sanford, Fla., has now become the symbol of a cautionary tale after neighborhood block captain George Zimmerman shot and killed 17-year-old Trayvon Martin inside a gated community. Martin was unarmed, with only a bag of Skittles in his pocket.

Despite dispatchers telling Zimmerman he did not need to chase Martin, who told his girlfriend he thought he was being followed and tried to run away prior to the shooting, Zimmerman followed and ultimately shot Martin.

However, Zimmerman has not been arrested or charged in the case because Florida's gun law allows a person to stand their ground and not retreat if they feel threatened with serious harm.

That law is very similar to one authored by Minnesota Rep. Tony Cornish, which would have lowered the legal standard for using deadly force, eliminated the requirement to retreat, and would have provided immunity from prosecution and lawsuits had it not been vetoed by Gov. Mark Dayton.

Walking the beat of the Northeast Citizen Patrol is hardly risk free, and John Schulte knows it rarely ever comes without hassle.

"We're called every name in the book," he told FOX 9 News.

Still, in seven years of chasing drug dealers off the corners on Central Avenue, Schulte says he's never packed heat even though he has a permit to carry.

"I think mostly, I don't want to become a victim of the court system," he said.

Dayton vetoed the law last week after law enforcement officers banded together to express their concerns about increased risk to those who carry the badge.

I think this Florida law also shields the shooter against liability if he injures an innocent bistander too.

Yeah, the National Rifle Association pushed that law on FL in 2005 (payed off politicians). Åny thinking person could tell you the dangers of such a vigilante/Old West type law and this young man's death is a direct result.

The law presupposes rational thot by the gun wielder - and when have we seen rational thot come out of Floridians? I can only hope that the legislature reconsiders this law and hope the citizenry remain outraged enuf to counter the bullshit from the NRA when they try to prevent dumping this stupid dangerous law.

While by law this asswipe may have an out for shooting the boy claiming 'self defense' there is one thing on the 911 recording where he talks about the 'coon' he was following. Hopefully the feds can put him on trial for a hate crime, or for violating the boy's civil rights.

I am fearful this guy is going to get away with this. Though I wonder just how safe he will be if he never sees a day behind bars because of this.

Clearly, there is something wrong with him. He has a history of emergency calls and directly disregarded police instruction.

I hope he is charged and hope this stays in the news long enough to put pressure on the local department to press charges or to at very least fully cooperate with the FBI.

Yeah, he looks a lot more menacing than the kid he killed. Anyone could walk up next to him in Florida and blow him away - then say they 'felt' threatened and held their ground. Especially knowing he is one of the nutcases with a permit to carry.

Ya think the pigs that are giving him a pass would bother prosecuting anyone else another white guy for doing that?

This protest has gone nationwide and forcing some action. The feds are now trying to calm ppl because it is getting scary as a civil rights case.

More protests and demonstrations in Florida tomorrow as there were today. Enuf pressure was put on Sanford that the city commission voted unanimously to dump the police chief that botched any investigation or arrest.

We are just waiting for them to arrest the asswipe. Hopefully they can make a civil rights violation case that will supercede the stupid Florida law that allows you to murder someone and claim self-defense.

Also I am writing to my state senator to support ditching that law. The black caucus is bringing it up in the next session. This is not the first black person murdered under that law. Even the fat white senator that made the law in 2005 agrees it needs to be changed. Why anyone but those fanatics at NRA would even consider this kind of law is beyond me. NRA should be put on the terrorist list.

Fortunately it looks like the feds are going to investigate. I have to say though I am appalled by a law that says its ok to shoot someone if you "feel" threatened. Pretty shocking. Trayvon was a beautiful boy so sad.

Well, now that the details are out there and ppl are getting outraged, experts in the field are concluding that the police should have arrested this asswipe, even with the stupid gun law and let the courts sort it out.

'Stand Your Ground Law' at center of Fla. Shooting

    CURT ANDERSON
    From Associated Press
    March 22, 2012

MIAMI (AP) — Florida is among 21 states with a "Stand Your Ground Law," which gives people wide latitude to use deadly force rather than retreat during a fight. The self-defense law helps explain why a neighborhood watch captain has not been arrested in the shooting death of an unarmed teenager.

The Florida law lets police on the scene decide whether they believe the self-defense claim. In many cases, the officers make an arrest and leave it to the courts to work out whether the deadly force is justified. In this case, however, police have said they are confident they did the right thing by not charging 28-year-old George Zimmerman.

The Justice Department and FBI have opened a civil rights investigation, and the local prosecutor has convened a grand jury April 10 to determine whether to charge Zimmerman. (Only AFTER nationwide protests to this selective law enforcement – RB)

Based on what's publicly known about the case, Michael Siegel, a former federal prosecutor who now directs the Criminal Justice Center and Clinics at the University of Florida law school, said it appears Sanford police were too quick to decide whether Zimmerman should be charged. If the evidence is murky, he said the usual practice is to make the arrest and let the court system sort it out.

"The law has definitely shifted and given a signal to law enforcement to be more careful," he said. "But in a case where the self-defense claim is weak, you would think they would do their job." ...

Late Wednesday, commissioners in Sanford, a city of 53,000 people outside Orlando that is 57 percent white and 30 percent black, voted 3-2 to express "no confidence" in the police chief.

Under the National Rifle Association-backed Florida law passed in 2005, Florida, unlike most other states, grants immunity from prosecution or arrest to suspects who successfully invoke the "stand your ground" claim. And if a suspect is arrested and charged, a judge can throw out the case well before trial based on a self-defense claim ...

Still, it's not enough for Zimmerman or anyone involved in a confrontation to simply claim innocence based on no duty to retreat, said Fordham University law professor Nicholas Johnson.

"By the Florida law, he is not relieved of the traditional and basic requirement of showing that he fairly perceived an imminent deadly threat," Johnson said.

Crump, the Martin family attorney, said the teenager weighed about 140 pounds and was carrying a bag of Skittles and a can of ice tea he had bought at a nearby convenience store when Zimmerman began following him in his sport utility vehicle. Zimmerman, meanwhile, weighs around 200 pounds and was armed with a 9mm semiautomatic handgun, which he had a permit to legally carry.

"So the facts that have come out that I have become aware of, would tend to indicate he should not be granted immunity," Roger Weeden, an Orlando defense attorney closely following the case, said of Zimmerman. ...

State Sen. Chris Smith, a Fort Lauderdale Democrat, said he is preparing a bill that would not allow a self-defense claim in cases where the shooter appeared to provoke the victim. That could have be a factor in the Martin case, where 911 calls and other evidence shows that Zimmerman was following the teenager in his vehicle and approached him aggressively despite specific instructions from police to back off.

"Stand your ground appears to be giving suspects better protections from arrest and prosecution than increased security measures for the citizens the law was originally intended to protect," said Smith, whose bill would also limit legal use of lethal force to places such as a person's home, car or workplace.

This story was the lead on the local TV news at 6 tonight.

The students here in S. FL where Trayvon went to school just left their classes today and filled the streets (a Twitter event).

There were huge crowds in Sanford where he was killed and the police chief resigned, tho only temporarily. Hopefully the city manager will make that permanent next month.

On a good note, the Asswipe Zimmerman is in hiding because of death threats. He should be scared because there are some who would just blow him away and claim self-defense. Hey, he scares me.

Hopefully the momentum won't die until the next session when they can get rid of this ridiculous Old West "stand your ground" law that legalizes murder in Florida (We were the first with this but there are 20 something states with similar laws - Illinois being one)

Something tells me he won't get away with this. He CAN'T. Just simply can't. And it's being reported that he's in hiding. There needs to be a warrant issued for his arrest IMMEDIATELY. The process is moving along too slow so he's not even considered a flight risk. As far as Florida is concerned, I'm glad I decided not to move there after pestering from my mother. They truly are fucking ancient in their thinking. My God.......

Outrage Geraldo Rivera blames hoodie for Trayvon's death; critics tell him to zip it up

Post by Alan Smithee Fri Mar 23, 2012 7:07 pm

So now besides Facebook, hoodies are the Devil? If the state of Florida pulls it's head out of it's ass and prosecutes this shithead, we'll see The Hoodie Defense?

Zip it up. That was a common reaction Friday on the Web and elsewhere to Fox News personality Geraldo Rivera’s comments that the hoodie was as much to blame for Trayvon Martin’s death as the shooter.

“Geraldo Rivera of Fox News has lost his mind. He's saying #Trayvon Martin wearing a hoodie helped cause his own death?” CNN commentator Roland Martin, who is black, tweeted.

“Hey Geraldo, Black kids have gotten shot not wearing hoodies. Dude, that's just dumb.”

Rivera stirred up a firestorm when he said on Friday’s “Fox & Friends” that the black Florida teen might not be dead had he not worn a hoodie the night he was shot by a community watch volunteer George Zimmerman.

“I believe that George Zimmerman, the overzealous neighborhood watch captain, should be investigated to the fullest extent of the law, and if he is criminally liable he should be prosecuted. But I am urging the parents of black and Latino youngsters particularly to not let their children go out wearing hoodies,” Rivera said.

“I think the hoodie is as much responsible for Trayvon Martin’s death as George Zimmerman was.”

He added: "You have to recognize that this whole stylizing yourself as a gangsta, you’re going to be a gangsta-wannabe, well people are going to perceive you as a menace."

The outspoken “Geraldo at Large” host, who is Latino, expressed similar sentiments in a column Friday titled, “Trayvon Martin Would Be Alive but for His Hoodie.”

Trayvon Martin Shooting: George Zimmerman Kicked Out Of Seminole State College

Seminole State College will expel Trayvon Martin's avowed shooter, George Zimmerman, due to what they term the "high-profile controversy" surrounding his role in the 17-year-old's death.

Zimmerman has been an on-and-off student at the college since 2003. As of 2009, he was working Associate in Arts degree.

The school released a statement on their decision:

"Due to the highly charged and high-profile controversy involving this student, Seminole State has taken the unusual but necessary step this week to withdraw Mr. Zimmerman from enrollment. This decision is based solely on our responsibility to provide for the safety of our students on campus as well as for Mr. Zimmerman."

On February 26, Zimmerman, a volunteer neighborhood watchman, spotted Martin as he was walking home from 711 carrying skittles and some iced tea. and talking to his girlfriend. Zimmerman called 911 and told the dispatcher he was following someone "suspicious." Despite being told by the 911 dispatcher not to follow Martin, Zimmerman pursued him. The two briefly struggled, and Zimmerman shot Martin in the chest and killed him.

Zimmerman told the police he shot the teenager in self-defense. He has yet to be charged.

Now they need to kick that bullshit law out too.
