CINCINNATI (AP) — A gay student whose southwest Ohio high school prohibited him from wearing a T-shirt designed to urge tolerance of gays is suing the school, saying it's violating his freedom of expression rights.

The mother of 16-year-old Maverick Couch filed the federal lawsuit on his behalf against Wayne Local School District and the principal of Waynesville High School, northeast of Cincinnati.

Couch is a junior at the public school. His lawsuit says he's been threatened with suspension if he wears a shirt bearing the message "Jesus Is Not a Homophobe." The lawsuit says school officials told him the shirt is "sexual in nature" and inappropriate.

The lawsuit asks that school officials be ordered to allow Couch to wear the shirt. It also seeks unspecified damages.

School district Superintendent Patrick Dubbs said Tuesday he hadn't seen the lawsuit and couldn't comment.

Now if they lose the lawsuit is this going to be another teen suicide?

The kid should have been allowed to wear the shirt. I am all for lawsuits in cases like this but I don't agree with the plaintiff walking away wealthy. I think a case like this should be about winning the right to wear the shirt and lawyers fees paid. No monetary profit for something like this, IMO.

This kid doesn't seem like the suicidal type. More of a stand fast and tell it like it is type. Hmm, I caused trouble like that when I was in HS. Hope they win - the T-shirt message was not all that controversial.

Let him wear the shirt. Not sure about monetary damages. But I hope this is just the kid standing up for what he believes & I think that's fantastic.

I agree. Honestly it's not a big deal. Strange the way some people feel the need to sexualize every little thing. The school needs to lighten up.

LOL. This country is way too lawsuit happy.

WAYNESVILLE, Ohio — A federal judge decided yesterday to allow a Waynesville High School student to wear a T-shirt with the slogan “Jesus Is Not a Homophobe” to school — pending a final decision in a lawsuit filed a day earlier in U.S. District Court in Cincinnati.

The lawsuit accuses Principal Randy Gebhardt and the Wayne Local Schools of violating junior Maverick Couch’s First Amendment rights by forcing him to turn the shirt inside out in April 2011. Couch wore the shirt on a national Day of Silence, held to draw attention to the bullying of lesbian, gay, bisexual and transgender students.

You have to wonder now how often he will wear it. Every day? Every other day? Only one or two more times? Once he won right in court to wear it you just know his peers are going to wonder daily if he's going to wear it.
