A teacher who had sex with a 15-year-old student has escaped being jailed - after her victim pleaded with the court to show leniency.

Nadia Diaz, 26, was sentenced to three years of probation, much to the delight of the boy she had sex with.

The victim, now aged 18, said he had persuaded Diaz to sleep with him and claimed he was to blame for her being prosecuted.

The teen told the court: 'I personally feel that this is one of the rare cases where it shouldn't be taken as child abuse.

'I believe 100% that Mrs Diaz made a big mistake and definitely after we had ended whatever relationship we had, she realised it.'

The teen, who cannot be identified, had asked the substitute teacher for her phone number while they were at Washington Union High School in Fresno, California.

Their texts soon became sexually explicitly and the pair ended up having sex twice at friends' houses.

Diaz was arrested after rumours started circulating the school about her improper relationship in January 2010.

A court in Fresno was told Diaz was ashamed of her behaviour, and a letter in which she expressed her shame and guilt were read out.

But her lawyer said her probation was the right sentence.

Diaz wept as she was told she will served three years probation and 30 days in an adult offender work programme.

She was also told she will lose her teaching certificate for life.
