    In your opinion, should pleading temporary insanity be a legitimate defense in our judicial system or lessen someone's sentence?

    Well, since an insanity defense of any kind is so hard to prove, and that works both ways, so it rarely pays off for the person using it, I don't see why it shouldn't be a defense, let them jump through all the hoops they want, odds are it's still not going to work.

    I just heard somewhere on a news program that only 1% of cases plead temporary insanity and only in 1/4 of those cases does the defense succeed.

    But to answer your question, it should be absolutely a part of the judicial system. Some people truly are insane and they don't need prison, they need psychiatric care. And in prison they aren't going to get the care they need.

    It is pretty ridiculous when it is used because it it usually b.s. and everyone knows it, so it doesn't work. It always seems like grasping at straws by the defense.

    I think there are occasions when it happens and that it should be part of the legal system, but those cases are few and far between.
