    Father Allegedly Kills Man Who Molested His Daughter, Texas Cops Say

    Sheriff's deputies in Texas won't file charges against a father who they say beat an acquaintance to death after allegedly catching him sexually abusing the man's 4-year-old daughter.

    During a social gathering on Saturday, the girl went inside the family's home in Shiner while other members of the family were tending to horses outside, CNN reported
    The father caught a 47-year-old man -- with whom he was casually acquainted -- attempting to molest his daughter, Lavaca County Sheriff Micah Harmon told the Victoria Advocate. The father then allegedly punched the man in the head until he died, Harmon reported.

    The father and daughter weren't named to protect the identity of the 4-year-old girl. She was described as "ok, besides the obvious mental trauma" of the incident, Harmon said.

    The alleged abuser was found dead at the scene. His name wasn't released pending the announcement of his death to his family.

    The sheriff's office will defer to a grand jury to decide whether charges will be brought against the father.

    "You have a right to defend your daughter," he told CNN. "[The girl's father] acted in defense of his third person. Once the investigation is completed we will submit it to the district attorney who then submits it to the grand jury, who will decide if they will indict him."

    The father was reportedly "very remorseful" about the death and did not know the alleged abuser would die of his injuries.

    While I am totally against vigilantism, I feel pretty sympathetic toward this father. I don’t think he should go to jail, though he did kill someone. What should his punishment be or should he go unpunished?

    This was brought up in passing a while back on another thread...it sounds like it is and if it isn't I'd like to know why else he did kill him especially in that matter because you DON'T generally think of hitting somebody in the head until they're dead unless you're using an object with some weight or a blunt edge on it.

    They probably will not indict him for two reasons.

    1. It's fucking Texas
    2. They know it would be a waste of time & money because no jury would convict him anyhow.

    Eh, I don't even know. If he does go to jail, I just hope the sentence is on the more lenient side.

    He took a life, but doesnt belong in jail. I would say give him probation. A conviction might prevent him from getting a new job tho.

    techinically the defense of others law states that you can only hurt someone until there is no more threat. once the guy was on the ground and incapacitated, he was no longer a threat and should have called the police.

    But would I find him guilty--- No.. and like shale said, no jury would convict him, cause it only takes one like me--- or a parent on the jury.

    His punishment should be either one or two things. Either he should be prosecuted with first degree murder, hand held accountable to the fullest extent of the law (justification: he took the law into his own hands, and confronted a guy with motive and intent to kill) OR, he should get off scot-free without any punishment at all! (justification: It was self defense! If someone is attacking you or your child, you have ever right to defend yourself and your family from the assailant. If they should happen to die as a result, SO BE IT!)

    What should absolutely NOT happen is him being charged with the crime of murder or manslaughter then getting a "lesser sentence" because the jury is "sympathetic" to his cause. Doing so sends the wrong message to everyone. It suggests that, if you happen to get into a similar situation, and feel the need to protect your child at all costs, then the law still considers you "guilty" in some way. It suggests that, the assailant is somehow a "victim" and that there is no course of action you should take to protect your loved ones beyond simply calling the cops. Either the guy committed a crime or he didn't! If he committed murder, then he should be punished for the crime of murder. If he didn't, then he should get off. But self defense is NOT a crime! If someone punches you in the face and in the course of defending yourself the attacker dies, that doesn't mean that you were the aggressor, it just means he lost the fight!

    He caught the guy in the act apparently, what kind of father would just say "Carry on there old chap"? The molester deserved to die the child was 5 years old. Hell I would have killed him too had it been my little girl.
