In general, how would you handle a situation where your physician misdiagnosis you?

    Second question:
If a doctor misdiagnoses you and almost kills you with medication, do you think they should be charged with assault or attempted murder?

I have been misdiagnosed and it is infuriating, but my experience was that the doctor who found the mistake had the first guy's back in saying that it could have been missed by anyone. So, I don't know, seems to me that it would be hard to do anything legally about it.

As far as the second question, I don't think we need to criminally go after doctors for mistakes. But they should be sued if the mistake results in death of a drastic decrease in quality of life.

Diagnosis is not an exact science as many symptoms can be from a variety of problems. I have had dermatologists misdiagnose my miliaria as a form of acne and gave me meds that aggravated the condition before I got a second, correct diagnosis and treatment.

I was annoyed that they didn't take the time to see all the facts (hot humid weather on onset clued the Dr. who diagnosed correctly) Now I have a whole typed history and annoy dermatologists by telling them it is miliaria.

Lawsuits against doctors are common. One of the reasons health care costs are so high is because doctors have to protect themselves and get multiple tests to rule out all causes of symptoms in order to come to a correct diagnosis.

I was misdiagnosed & it could have been fatal. Another doc found it because I was suspicious & went to another one. Didn't sue him but I didn't pay the bill the sonofabitch sent either.

That's why I would seek more than one opinion if I was diagnosed with something serious before I would proceed with any treatment. Doctors ARE humans too who can make mistakes. And since I'm the type to actually have a good idea of whats going on with before I even enter a doctor's office.....anything that sounds skeptical to me would get another opinion.

And no....they shouldn't be charged with either of those crimes unless it was malicious. That's why they have malpractice insurance.

This one wasn't human. He was a fucking dumbass. He assumed because it's extremely rare, it was impossible. It was a cheap test to just rule it out. That's not a mistake. That's an incompetent fuck.

Depends on how serious it was. If he told me a needed surgery for something, I'm getting a second opinion anyway.

    Second question:
If a doctor misdiagnoses you and almost kills you with medication, do you think they should be charged with assault or attempted murder?Maybe in an extreme case such as they were bombed out of their skull when they wrote my prescription I suppose some zealous prosecutor could charge them but typically that would come under malpractice.

When my wife and I were just dating her father dropped dead in their living from a massive heart attack. Now granted he had some high risk factors like smoking and high blood pressure but he had been complaining of "indigestion" for a while before he died. His doctor had him on antacid.

I was 43 and knew something was seriously wrong. I had chest pains so bad I could barely walk. My idiot doctor at the time refused to give me the treadmill test I begged for and insisted it was "indigestion". I knew better, and a month later I consulted another doctor, which got the ball rolling. Cardiologist I ended up referred to thought I was a walking miracle to still be alive.

But, see, I didn't fit "the profile". I was female, young, looked even younger, and was fit (or thought I was). Genetics doesn't care so much about physical profiles. After all I went through I just let it all drop, didn't want to deal with the Idiot Doctor at all. But I wish I had marched into his office later and gave HIM a big lesson. He is still practicing. A friend at work has her as her doctor. I've warned her that she had better hope she doesn't develop heart disease as a young woman or she might just die.

That's why education is so important. Sometimes even though we've been almost conditioned to "trust the doctor knows best", we still have to take things in our own hands. My case was similar in that there were NO predisposing factors. It didn't make sense. This 1% chance (as he called it) was the only thing that did. And this asshat refused to order a cheap test to at least rule it out.
