If a couple is divorcing and it is brought up that one spouse had an affair during the marriage, should that fact work against them during proceedings? IOW, they cheated so they get less of the community property, or have to pay more in spousal support.

I don't think there should be an "affair fee". I think it's better to separate first but shit happens & sometimes the affair isn't wrong. It really depends on the situation. It should be grounds for the divorce if one is contesting. But I don't know that it should land somebody in the penalty box.

Probably depends on how arbitrary and cruel the cheating spouse was about the affair.
