    Scenario a:
    A woman is scorned by a man so bad that she exacts revenge by claiming rape.

    Scenario b:
    A woman somehow believes she had been raped, makes a huge case against the man accused, but she later realizes that she was mistaken.

    What would you say should be the penalty for both scenarios?

    A: Jail. Lots of it. 20 years.

    B: Depends on the situation. If she makes an honest mistake, that's one thing. Sounds like she should be psychiatrically studied before making a decision.

    B.? Can someone creative please give me a scenario where a woman can honestly believe she was raped but later come to find out she was mistaken? Regardless, if she really thought she was, then I don't see a crime. When someone is falsely convicted through faulty eyewitness testimony, the witness isn't charged with a crime unless they perjured themselves.

    Thats why I said jail both times. There is no way for a woman to believe that she was mistakenly raped. Mistaken identity I can get with.....bit not rape in and of itself.

    i think scenario a: definite jail time

    b: there is no intent, which in most cases needs to be connected to prosecute/convict. one exception is manslaughter--u didnt mean to kill him, just assault him, but he's dead.

    Scenario 2 - depends on the circumstances - was it mistaken identity, what made her think she'd been raped, and so on
